Welcome to Xtrecy Logo Design Service. These terms and conditions outline the rules and regulations for the conduct of our logo design projects. By engaging our services — through payment, brief submission, or any other means — you agree to abide by these terms. Please read them carefully before commencing work.
01.GENERAL POLICY
1.1 Service Provider
Xtrecy, operating from Bangladesh.
1.2 The Client
Any individual or entity seeking logo design services from us.
1.3 Acceptance of Agreement
Making a payment, providing design briefs, or utilizing our services in any way signifies your acceptance of these Terms and Conditions.
02.WORKFLOW AND TIMELINES
2.1 Nature of Work
We provide custom logo designs based on your requirements. The number of concepts, revisions, and file formats will be determined by your selected package.
2.2 Commencement
Work begins only after receiving the initial payment and a clear design brief. Delays in providing feedback will lead to a proportional extension of the project deadline.
2.3 Urgent Delivery
If a project is required before the scheduled timeline, an additional 25% rush fee will be charged (subject to availability).
2.4 Working Days
Timelines mentioned in packages refer to working days. While support is available on Fridays and Saturdays, the design and development teams remain off.
2.5 Initial Concepts
Startup: 2 working days. Premium: 4 working days. Business: 6 working days.
2.6 Revisions
Typically take 1–2 working days, though this may vary based on workload.
2.7 Live Revisions
Live revisions or additional concepts/revisions require upfront payment.
03.CLIENT RESPONSIBILITIES
3.1 Accuracy of Information
All information provided for the design must be accurate, complete, and truthful.
3.2 Timely Feedback
Feedback must be provided within 3 working days. Failure to do so will put the project "On Hold." If no response is received for 10 consecutive working days, the project will be marked as "Closed" with no refund.
3.3 Client-Provided Assets
If you provide text or images for the design, you must ensure they do not violate copyright or trademark laws. Xtrecy is not liable for any legal issues arising from client-provided materials.
3.4 Final Version
Once a design is finalized and confirmed, any significant changes requested thereafter will be treated as a new project and incur additional fees.
3.5 Misuse
The client bears full responsibility for any illegal use or misuse of the logo. Xtrecy holds no liability in such cases.
04.FEES AND PAYMENT TERMS
4.1 Payment Schedule
50% Advance Payment is mandatory to start. The remaining 50% Balance must be paid before the final file delivery. Invoices must be settled within 7 days of receipt.
4.2 Refunds
Once design work has commenced, the advance payment is non-refundable.
4.3 Late Payments
A 10% late fee applies to overdue payments. If a payment is delayed by more than 10 days, files and services may be suspended.
4.4 Additional Charges
Extra Concept: 30% additional fee. Extra Revision: 20% fee per revision.
4.5 Finality
No refunds are provided once the work has started.
4.6 Project Cancellation
Projects will be canceled if the final payment is not cleared within 30 days.
05.COMMUNICATION CHANNELS
Approved Channels
We communicate exclusively through: WhatsApp Chat, Google Meet, and Email.
Note
Meetings via Google Meet can be arranged after the initial brief. For repeated revisions, a 20% extra fee allows for "Live Fixing" via Google Meet. Verbal instructions or phone calls are not legally binding; all instructions must be documented via our official channels.
06.INTELLECTUAL PROPERTY & PRIVACY
6.1 Ownership
Upon full payment, the client gains the right to use the finalized logo.
6.2 Unused Concepts
Rights to all concepts not selected as the final version remain with Xtrecy. We reserve the right to upload these to our portfolio or stock sites (e.g., Freepik, Adobe Stock).
6.3 Privacy Fee
To prevent your logo from appearing in our portfolio or stock sites, a 20% Privacy Fee applies.
6.4 Trademarking
We provide the design only. Trademark registration is the client's sole responsibility.
6.5 Data Privacy
All client information is used strictly for project purposes.
07.DELIVERY AND SECURITY
7.1 Formats
Final files are delivered in AI, EPS, PNG (transparent), and JPG formats.
7.2 Logo Kit
Includes patterns, color codes, social media versions, and icons.
7.3 Backups
Files are stored for 30 days post-delivery. Requests for files after this period may incur a recovery charge.
08.TERMINATION AND LIABILITY
8.1 Termination
Clients may terminate the contract via written notice; however, advance payments remain non-refundable. Xtrecy may terminate the contract for non-payment or lack of communication.
8.2 Limitation of Liability
Services are provided "as is." Xtrecy is not liable for indirect damages. Our total liability shall not exceed the amount paid by the client.
8.3 Force Majeure
Xtrecy is not responsible for delays caused by emergencies (power outages, illness, natural disasters).
8.4 Governing Law
These terms are governed by the laws of Bangladesh. Disputes will be settled within the Bangladeshi judicial system.
09.MISCELLANEOUS
9.1 NDA
For sensitive projects, a signed Non-Disclosure Agreement (NDA) can be provided for a fee ranging from ৳500 to ৳5,000.
9.2 Changes to Terms
Xtrecy reserves the right to update these terms at any time. Continued use of our services implies acceptance of the updated terms.
